Buying property in Uttarakhand from outside the state
In February 2025 Uttarakhand passed a stricter land law. Many listings online still advertise land that most buyers from Delhi, Mumbai or abroad can't legally purchase. Here's what changed, in plain language.
This is a general guide, not legal advice. Rules are applied case by case (municipal limits, cantonments, converted land and project approvals all matter). Every Suryodaya listing is reviewed by an advocate, and you should have your own lawyer review documents before paying anything.
The short version
No agricultural or horticultural land in 11 districts
Non-residents cannot buy farmland or orchards in Almora, Bageshwar, Chamoli, Champawat, Dehradun, Nainital, Pauri Garhwal, Pithoragarh, Rudraprayag, Tehri Garhwal, Uttarkashi.
Haridwar and Udham Singh Nagar need state approval
In the two plains districts, land purchases by non-residents need approval from the state government, not the local District Magistrate.
Residential land: 250 sq m, once, with an affidavit
That's about 2,690 sq ft or 1.25 nali. You declare at registration that you and your family haven't bought such land before.
Flats in approved buildings are generally fine
Buying an apartment isn't a farmland purchase. Check that the project has map approval and, where required, RERA registration.
Documents to check before paying a token

Khatauni (record of rights)
Confirms who owns the land, its khasra number, area and category. The seller's name must match.

Sale deed chain
Previous sale deeds going back 30 years, so you know how the seller came to own it.

Mutation (dakhil-kharij)
Proof the land records were updated in the seller's name after they bought it.

Land-use / Section 143 order
If agricultural land has been converted to non-agricultural use, there should be an order. Without it, treat the land as agricultural.

Map approval
For built homes and projects: the approved plan from the development authority or local body, and a completion certificate where applicable.

Encumbrance and dues
No bank loans, court cases or unpaid dues attached to the property.

RERA registration
For projects above the RERA threshold, check the registration on the Uttarakhand RERA website.
Hill-specific checks portals don't mention
Slope and landslide history
Ask neighbours about cracks and slips after monsoon. Look for retaining walls and drainage.
Monsoon road access
A road that's fine in March can close for hours in August. Visit in or just after the rains if you can.
Water source
Jal Sansthan supply, spring or borewell? Springs can dry in May–June. Check storage capacity.
Walk from the road
A 150 m walk downhill is charming until you carry groceries, gas cylinders or a suitcase up it.
Seismic zone
Uttarakhand lies in high seismic zones. Prefer earthquake-resistant construction and ask who built it.
River setbacks
Land close to rivers, including the Ganga, can fall under flood-plain and building restrictions.

Common questions
Can someone from outside Uttarakhand buy a flat in Rishikesh or Dehradun?
Generally yes. The 2025 restrictions target purchases of agricultural and horticultural land and cap residential land. Buying an apartment in an approved residential building is not treated as buying farmland. We still confirm the building's land use and approvals for every listing.
Can I buy agricultural land and build a house on it?
Not in 11 of Uttarakhand's 13 districts if you are not a resident. In Haridwar and Udham Singh Nagar, a non-resident can apply for state government approval. Land that has been legally converted to non-agricultural use (Section 143) is treated differently. Check the conversion order, not the seller's word.
What is the 250 sq m rule?
A non-resident family can buy up to 250 square metres (about 2,690 sq ft, or 1.25 nali) of land for residential use, once, and must file an affidavit at registration declaring that neither they nor their family have bought such land before. Larger plots need permission.
What happens if the rules are broken?
The state can take the land, and false affidavits can lead to legal action. This is why we won't take a token payment until our advocate has confirmed eligibility in writing.
Is an NRI treated as an outsider?
Eligibility depends on residency status under state law and foreign exchange rules, not just where you currently live. NRIs can usually buy residential property in India but not agricultural land. Talk to us before you shortlist.
How much is stamp duty in Uttarakhand?
Stamp duty is generally 5% of the property's value (the higher of the deal value and the government circle rate), with concessions for women buyers, plus registration fees. Confirm current rates with the sub-registrar or your advocate before you budget.
